ADDENDUM C - PET ADDENDUM

1.     Except as modified by Paragraph 3, below, no animals or pets of any kind shall be kept on the premises or in Resident’s apartment without Landlord’s written permission (which permission may be granted or denied in Landlord’s sole and absolute discretion). 

2.     A pet will be defined as a common household pet such as a dog, cat, bird, guinea pig, gerbil, hamster, rabbit, or fish.  Reptiles and birds of prey are not household pets and therefore, may not be maintained in Resident’s apartment.  Pets, other than cats and dogs, shall have suitable housing, e.g. cages or aquariums.  Full or mixed breed aggressive animals or attack dogs including, but not limited to: Akita, American Bandogge, Alaskan Malamute, American Staffordshire Terrier, Basenji, Bull Mastiff, Cane Corso, Chow, Dalmatian, Eskimo Spitz, German Shepherd, Giant Schnauzer, Great Dane, Husky, Pres Canario, Saint Bernard, Tosa Inu, Wolf Hybrid, Pit Bull, Rottweiler and Doberman Pinschers are specifically and expressly prohibited.

3.     Notwithstanding Paragraph 1, above, Landlord grants permission for Resident to have no more than two (2) cats, dogs or caged mammals per apartment.  A maximum of two birds may be permitted and in the case of fish no more than one aquarium with a twenty gallon capacity shall be allowed.

4.     Resident shall provide management with the following information and documents which will be kept on file in Resident’s folder:

(a)   A color photograph identifying the pet.

5.     Resident shall carry an identification card, naming the veterinarian and caretaker with them.  In the event of a sudden illness or accident, attending authorities would notify Landlord to assist the pet and avoid delay in the proper care of the pet. 

6.     No pet is to remain unattended without proper care for more than twenty-four (24) hours except in the case of a dog, which shall be no more than twelve (12) hours.

7.     If the health or safety of a pet is threatened by incapacity or death of Resident, or for any other reason, Landlord will endeavor to contact the caretakers designated by Resident.

8.     If either of the caretakers are unable or unwilling to assume responsibility for the pet and a substitute caretaker cannot be located, Landlord may enter the apartment, remove the pet and arrange for pet care for no more than ten (10) days to protect the pet.  All costs and expenses for such care will be deducted from Resident’s pet security deposit.  Landlord may then contact the local humane society or animal control facility if the caretakers cannot be located.

9.     Resident shall:

(a)   Be responsible for the proper care, good nutrition, exercise, flea control, routine veterinarian care and yearly inoculations of the pet.  Dogs and cats must wear identification tags on collar when outside the apartment.

(b)   Be responsible for cleaning up after the pet inside and outside the apartment and anywhere on the premises.

(c)   Keep the apartment and patio or deck, if any, clean and free of pet odors, infestation, waste, litter and maintain the apartment in a sanitary condition at all times.

(d)   The Residents shall not leave pets on the balcony/patio for an extended time, nor shall they allow pets to relieve themselves on same.

(e)   Restrain the pet and prevent the pet from gnawing, chewing and scratching or otherwise defacing doors, walls, windows, and floor coverings of the apartment, other apartments and common area, as well as shrubs and landscaping of the complex.

(f)    Restrain the pet at all times when outside the apartment.  Residents are legally responsible for the behavior of their pets at all times.

(g)   Keep pet from disturbing the health, safety, rights, comfort or quiet enjoyment of the premises by other Residents.

(h)   Make sure that pet will not create a nuisance to Resident’s neighbors by excessive barking, whining, chirping or other unruly behavior.

(i)     Contact the Superintendent when an accident occurs in a common area so that the proper cleaning procedures can be used.

10.  Landlord shall have the right to inspect the apartment on twenty-four (24) hours’ notice to Resident (unless in the event of an emergency) to be sure that the pet and apartment are being properly cared for.  These inspections may be reduced or increased in time periods at Landlord’s sole discretion.

11.  A pooper-scooper and disposable plastic bag shall be carried by Resident when outside the apartment with the pet.  All waste shall be bagged and disposed of in a receptacle determined by Landlord.  Toilets are not designated to handle pet litter and under no circumstances shall any pet debris be deposited in a toilet as blockage will occur.  Resident shall be responsible for the cost of repairs or replacements of any damaged toilets or pipes as a result of Resident’s misconduct.  Any cost in connection with these repairs or replacements shall be considered additional rent and collectable as additional rent.

12.  Use of the Bark Park or any common area shall be at the sole risk of the Resident.  Dogs must be leashed while entering and exiting the park.  Residents must be within the Bark Park and supervising their dog with leash readily available.  Dog handlers must be at least 16 years of age.  Children under 13 must be accompanied by adult and supervised at all times.  Aggressive dogs must be removed immediately.  Dogs should be under voice control.  Human and Dog food/treats, glass containers, dogs in heat, sick dogs, aggressive dogs and puppies less than 5 months old are prohibited from using the Bark Park.

13.  Resident is expressly responsible for any damage or injury caused to Resident’s apartment, the building or others as a result of Resident’s pet.  These responsibilities shall include, but are not limited to the following:

(a)   Repairing or replacing damaged areas of the exterior, interior, doors, walls, floor coverings and fixtures in the apartment, common areas or other areas damaged by the Resident’s pet.

(b)   Cleaning, deodorizing and sanitizing carpeting and other floor coverings in the apartment as necessitated by the presence of the pet.

(c)   All destruction of property.

(d)   Resident shall secure personal liability or other insurance and indemnify and hold harmless the Landlord, its agents, employees, other Residents and guest against all costs, damages, and claims.

(e)   Any charges for damages shall be considered additional rent and is collectable as additional rent under the Lease.

14.  Notwithstanding anything to the contrary contained in this Addendum, Resident shall permanently remove the pet from the apartment within five (5) days of notice from Landlord if Landlord determines, in its sole and absolute discretion, that (a) except as provided in clause 6, above,  the pet is not at all times under the control of Resident, (b) Resident does not properly care for or clean-up after the pet as required hereunder, (c) the pet is generally disruptive to the peace and quiet enjoyment of the other Residents of the building or (d) odors caused by the keeping of the pet are generally disruptive or offensive to the peace and quiet enjoyment of the other Residents in the building. In addition, Resident shall permanently remove the pet from the apartment immediately upon notice from the Landlord if Landlord determines, in its sole and absolute discretion, that the pet threatens the health or safety of: any other Resident or their invitees and guests, any employees employed at the building, or any contractors or vendors supplying goods or services to the building.

15.   A $400.00 non-refundable fee for dogs, cats or birds along with a fee of $50.00 per month per dog or bird and a fee of $25.00 per month per cat shall be charged in addition to Resident’s monthly rent as set forth in Resident’s lease.

16.  This Pet Rider is incorporated into the Lease as well as the rules and regulations of the building.  In the event there is a breach of any of the foregoing terms and conditions, the same shall be deemed a material breach of the Lease and the rules and regulations of the building, entitling the Landlord to exercise any and all of its rights and remedies under the Lease.
